KUALA LUMPUR, Dec 15 (Bernama) — A chief clerk was sentenced to six months jail by the High Court here today after she pleaded guilty to a charge of harbouring her terrorist husband.
Judge Kamardin Hashim handed down the sentence on Poziah (rpt: Poziah) Harun,42,and ordered the woman to serve the sentence from the date of her arrest,which was Aug 19 last year.
Before handing down the sentence,Kamardin said the offence committed by the accused was serious although her intention was to protect her husband so that he could receive treatment for injuries sustained in Syria.
He said the court took into account her guilty plea,although it should be done at the early stage of the case.
He said the court also took into account public interest.
“The offence in a terrorist act does not involve movement in groups,but also as an individual in various ways that can lead to destruction,like the extremist terrorists in France and Thailand,” he added.
Poziah,who has three children,was charged with harbouring Zulkarnain Ghaz Abd Ghani,31,despite knowing that he was involved in terrorist acts.
She was charged with committing the offence,under Section 130k of the Penal Code,at Poliklinik Azhar & Rakan-Rakan in Jalan Masjid,Taman Pekan Baru, Sungai Petani,Kedah,between September and December 2014.
After the proceeding ended,Poziah,who was in a black robe and shawl,was seen in tears and hugged by family members.
According to the facts of the case,Zulkarnain Ghaz contacted Poziah to inform her that he was back from Syria and wanted her to send him to the polyclinic for treatment of an injury he sustained during a battle in Syria.
However,Poziah sought the help of a friend,one Abdul Samad Abd Halim,to check the injury on her husband before sending him to the polyclinic.
During mitigation,Poziah’s lawyer,Mohd Hazrin Alif Wahab,said his client was only fulfilling her responsibility as a wife and that she had three school-going children to take care of.
The prosecution was conducted by deputy public prosecutor Wan Shaharuddin Wan Ladin.
Meanwhile,last Oct 9,Zulkarnain Ghaz was sentenced to nine months’ jail after he pleaded guilty to a charge of entering Syria to support terrorist activities there.
